1. About Us & Acceptance

www.thelovingcompany.com is operated by TLCUK Ltd T/A The Loving Company (“we”, “us”, “our”), Company No. 16067964, Address: Lytchett House, 13 Freeland Park, Wareham Road, Poole, Dorset, BH16 6FA. By accessing or using our website or purchasing products, you agree to these Terms.

We may update these Terms at any time. Continued use of the website after changes constitutes acceptance.

2. Eligibility & Age Restriction

You must be 18+ to use this website or purchase products. By ordering, you confirm you are at least 18 and legally capable of entering into a binding contract.

3. Orders, Pricing & Contract Formation

All orders are subject to acceptance and availability. A contract forms when we send your dispatch confirmation.
We use reasonable care to ensure pricing/stock accuracy; obvious errors may be corrected and orders cancelled/refunded before dispatch.
Prices include VAT where applicable. Delivery charges are shown at checkout.
We may refuse or cancel any order (e.g., suspected fraud, regulatory restrictions, delivery to unsupported locations).

4. Delivery, Title & Risk

Delivery times are estimates. Risk in goods passes on delivery; title passes on receipt of cleared payment in full.

5. Consumer Cancellations & Returns (UK)

Your statutory rights are preserved. Under the Consumer Contracts Regulations 2013 you may cancel most online purchases within 14 days of delivery and then have 14 days to return items.

Hygiene Exceptions: For health protection and hygiene, sealed goods that are not suitable for return once unsealed (including sex toys, underwear/lingerie/hosiery, consumables such as lubricants/oils/condoms/creams/sprays/bath products/edibles, latex clothing, face coverings/gags) cannot be returned once opened, unless faulty. Items sold as sets must be returned complete.

Refunds are made to the original payment method within 14 days of receipt of the returned goods. Unless we are at fault, you are responsible for return postage. See our Returns Policy for the full process.

6. Product Information, Safety & Use

Products are for lawful, personal use only. Always read labels/instructions before use.
Where stated, products are intended for adults only and may contain materials not suitable for persons with allergies or sensitivities.

7. Warranties & Faulty Goods

Your statutory rights under the Consumer Rights Act 2015 apply (goods must be as described, of satisfactory quality and fit for purpose). If a product is faulty, you are entitled to a repair, replacement, or refund in accordance with law and our Returns Policy. Many products also carry a manufacturer’s guarantee; we will support reasonable claims under such guarantees.

8. User Accounts & Security

You must provide accurate information and keep your login credentials secure. Notify us immediately of any unauthorised use.
We may suspend or terminate accounts for breach of these Terms or abuse of our services.

9. Acceptable Use

Do not upload unlawful, defamatory, obscene, infringing, or harmful content; do not spam or distribute malware; do not attempt to gain unauthorised access or disrupt services.
We may remove content or restrict access where reasonably necessary.

10. Intellectual Property

All site content (text, graphics, trademarks, software) is owned by or licensed to us. You may use it for personal, non-commercial purposes only. By submitting reviews or content, you grant us a worldwide, royalty-free licence to use, reproduce, and display that content for marketing and operational purposes.

11. Third-Party Links & Services

Links to external sites and integrations (e.g., payment processors, analytics, delivery partners) are provided for convenience. We are not responsible for their content, availability, or practices. Your use of third-party services is subject to their terms.

12. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your consumer statutory rights, or any other liability that cannot legally be excluded.

Subject to the preceding paragraph and to the maximum extent permitted by law:

We shall not be liable for any indirect or consequential losses, including loss of profit, revenue, data, goodwill, or business opportunity.
Our total aggregate liability arising out of or in connection with any order, whether in contract, tort (including negligence), or otherwise, shall be limited to the higher of (a) £100 and (b) the total amount paid by you for the products giving rise to the claim.
We are not liable for failure to perform or delay due to events beyond our reasonable control (see Force Majeure).

13. Indemnity (Your Responsibility)

You agree to indemnify and hold harmless TLCUK Ltd, its directors, employees, and agents from and against all claims, liabilities, damages, losses, and reasonable costs (including legal fees) arising from: (a) your breach of these Terms, (b) your unlawful or improper use of our products or website, (c) content you submit, or (d) your breach of any applicable laws. This clause does not reduce your statutory rights and does not apply to the extent a claim arises from our negligence or breach of statutory duty.

14. Force Majeure

We are not responsible for delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, extreme weather, industrial disputes, supplier failure, epidemics/pandemics, war, terrorism, utility failures, or governmental action. We will take reasonable steps to mitigate and will perform as soon as reasonably practicable.

15. Promotions, Gift Cards & Errors

Promotions and discounts are subject to availability and may be withdrawn or varied at any time. Unless stated, promo codes exclude clearance, gift cards, and shipping.
We reserve the right to cancel orders affected by manifest pricing or description errors prior to dispatch.

17. Complaints & Dispute Resolution

18. Severance

If any provision of these Terms is held unlawful, void, or unenforceable, the remaining provisions remain in full force and effect.

19. Governing Law & Jurisdiction

These Terms are governed by the laws of England & Wales. Courts of England & Wales have exclusive jurisdiction, except that mandatory local consumer protections may also apply if you reside elsewhere in the UK.
